General information regarding these instructions.

These instructions apply to the Labforge Bottlenose line of cameras. They are intended to make use of Bottlenose efficiently and safely. Local accident prevention regulations and national work safety regulations must be observed before, during, and after initial use.

Bottlenose is actively under further development and thus information contained herein is subject to change and applies to the latest firmware release.

Limitation of Liability

In no event shall Labforge be liable to the other or any third party in contract, tort or otherwise for incidental or consequential damages of any kind, including, without limitation, punitive or economic damages or lost profits, regardless of whether either party shall be advised, shall have other reason to know or in fact shall know of the possibility.

Labforge's liability and purchaser's exclusive remedy for any cause of action arising in connection with the sale or use of the goods, whether based on negligence, strict liability, breach of warranty, breach of contract, or equitable principles, is expressly limited to, at Labforge’s option, replacement of, or repayment of the purchase prices for that portion of the products and accessories with respect to which damages are claimed. All claims of any kind arising in connection with the sale or use of the goods shall be deemed waived unless made in writing within sixty (60) days from the date of seller's delivery, or the date fixed for delivery in the event of non-delivery.

Warranty

The term of warranty (“Warranty Period”) is for: (a) Products (other than Accessories) – twelve (12) months from the date of shipment, (b) Accessories – ninety (90) calendar days from the date of shipment. Labforge warrants that during the Warranty Period that: (a) the Products and Accessories will be free from material defects in material and workmanship and conform to Labforge’s specifications and (b) for Products and Accessories that are manufactured by a third-party, Labforge will extend the warranty coverage provided by the third-party, but Labforge does not independently warrant any third-party Products or Accessories and the third-party’s warranty term may not coincide with the Warranty Period. Purchaser’s exclusive remedy for a claim under this warranty shall be limited to the repair or replacement, at Labforge’s option, at Labforge’s facility, of defective or nonconforming Products or Accessories. All Products returned under warranty shall be returned to Labforge prepaid by the Purchaser. In the event that the returned Products are confirmed by Labforge to be a warranted failure, Products shall be returned to the Purchaser prepaid by Labforge.

The foregoing warranties do not extend to (a) nonconformities, defects or errors in the Products and/or Accessories due to accident, abuse, misuse or negligent use of the Products and/or Accessories; use of same in other than a normal and customary manner; environmental conditions not conforming to Labforge’s specifications; or failure to follow prescribed installation, operating and maintenance procedures; (b) defects, errors or nonconformities in the Products and/or Accessories due to modifications, alterations, additions or changes not made in accordance with Labforge’s specifications or as authorized in writing by Labforge; (c) normal wear and tear; (d) damage caused by force of nature or act of any third person; (e) shipping damage; (f) service or repair of the Products and/or Accessories by the Purchaser without the prior written consent of Labforge; (g) Products and/or Accessories designated by Labforge as test samples, experimental, developmental, pre-production, sample, incomplete or out of specification Products and/or Accessories; (h) returned Products and/or Accessories if the original identification marks have been removed or altered; or (i) services or research activities.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, THE AFOREMENTIONED WARRANTIES ARE EXPRESSLY IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES DOES LABFORGE WARRANT THAT ANY SOFTWARE WILL OPERATE UNINTERRUPTED OR ERROR FREE.

Restrictions on Product Use

Purchaser is responsible for complying with safety standards and for providing adequate designs and safeguards for their hardware, software and systems which minimize risk and avoid situations in which a malfunction or failure of Product could cause loss of human life, bodily injury or damage to property, including data loss or corruption.

Before Purchaser uses the Product, creates designs including the Product, or incorporates the Product into their own applications, Purchaser must also refer to and comply with (a) the latest versions of all relevant Labforge information, including without limitation, this document, the specifications, the data sheets and application notes for Product and (b) the instructions for the application with which the Product will be used with or for.

Purchaser is solely responsible for all aspects of their own product design or applications, including but not limited to (a) determining the appropriateness of the use of this Product in such design or applications; (b) evaluating and determining the applicability of any information contained in this document, or in charts, diagrams, programs, algorithms, sample application circuits, or any other referenced documents; and (c) validating all operating parameters for such designs and applications.

LABFORGE ASSUMES NO LIABILITY FOR PURCHASER’S PRODUCT DESIGN OR APPLICATIONS.
PRODUCT IS NEITHER INTENDED NOR WARRANTED FOR USE IN EQUIPMENTS OR SYSTEMS THAT REQUIRE EXTRAORDINARILY HIGH LEVELS OF QUALITY AND/OR RELIABILITY, AND/OR A MALFUNCTION OR FAILURE OF WHICH MAY CAUSE LOSS OF HUMAN LIFE, BODILY INJURY, SERIOUS PROPERTY DAMAGE AND/OR SERIOUS PUBLIC IMPACT ("UNINTENDED USE").

Except for specific applications as expressly stated in this document, Unintended Use includes, without limitation, equipment used in nuclear facilities, equipment used in the aerospace industry, medical equipment, equipment used for automobiles, trains, ships and other transportation, traffic signaling equipment, equipment used to control combustions or explosions, safety devices, elevators and escalators, devices related to electric power, and equipment used in finance-related fields.

IF YOU USE PRODUCT FOR UNINTENDED USE, LABFORGE ASSUMES NO LIABILITY FOR PRODUCT.

Do not disassemble, analyze, reverse-engineer, alter, modify, translate or copy Product, whether in whole or in part.

Product shall not be used for or incorporated into any products or systems whose manufacture, use, or sale is prohibited under any applicable laws or regulations.

No responsibility is assumed by Labforge for any infringement of patents or any other intellectual property rights of third parties that may result from the use of product. No license to any intellectual property right is granted by this document, whether express or implied, by estoppel or otherwise.

To the maximum extent allowable by law, Labforge assumes no liability whatsoever, including without limitation, indirect, consequential, special, or incidental damages or loss, loss of profits, loss of opportunities, business interruption and loss of data, and disclaims any and all express or implied warranties and conditions related to sale, use of product, or information, including warranties or conditions of merchantability, fitness for a particular purpose, accuracy of information, or noninfringement.

Labforge assumes no liability for damages or losses occurring as a result of noncompliance with applicable laws and regulations.
